Terms of sale

1. Scope

These Terms and Conditions of Sale (hereinafter the "Terms") govern:

The sale of products offered by Paloma Padel (hereinafter "Paloma", "we", or "our")
To any individual or legal entity wishing to make a purchase on the site https://palomapadel.com/ (hereinafter "the Site"),
collectively "the Customer".

Placing an order on the Site implies unreserved acceptance of these Terms.

3. Products

The products offered for sale are those shown on the Site at the time the Customer views it, subject to available stock.

Each product comes with a description stating its essential characteristics, price, availability and delivery conditions.

4. Orders

4.1 Account creation

The Customer may:

Create an account with a password,
Or order as a guest.

All information provided must be accurate and up to date. Paloma cannot be held responsible for input errors.

4.2 Validation

The order is deemed accepted after:

Validation of the summary,
Acceptance of the Terms,
Payment confirmation.

A confirmation email is sent to the Customer.

5. Prices

Prices are shown:

In euros (€),
Including all taxes,
Excluding delivery costs.

Paloma reserves the right to change its prices, but products are invoiced at the rates in effect at the time the order is validated.

6. Payment

Payment is made via the methods offered on the Site (e.g. credit card, PayPal, Apple Pay, Google Pay, etc.).

The transaction is secure, and banking details are never stored by Paloma.

7. Delivery

7.1 Areas

Products can be delivered:

In France,
Within the European Union,
Internationally (outside the EU) subject to the conditions displayed.

7.2 Times

The times shown are indicative. Delays may occur without Paloma being held responsible, particularly in the event of force majeure or customs.

7.3 Costs

Delivery costs are calculated at the cart and are the Customer's responsibility, unless a promotional offer states otherwise.

8. Right of withdrawal

In accordance with the French Consumer Code, the Customer has 14 days from receipt of the product to exercise their right of withdrawal without giving a reason.

The return must:

Be reported via the withdrawal form or by email,
Be returned in its original condition,
Include all its accessories and tags.

Return costs are the Customer's responsibility, unless otherwise stated.

9. Legal warranties

The Customer benefits from:

The legal warranty of conformity,
The legal warranty against hidden defects.

In the event of a proven defect or non-conformity, Paloma undertakes to repair, exchange or refund the product.

10. Liability

Paloma's liability can only be engaged in the event of proven fault.
Paloma cannot be held responsible for indirect or intangible damage related to the use of the Site or the products.

11. Intellectual property

All content on the Site (texts, images, trademarks) is protected by intellectual property law.
Any reproduction is strictly prohibited without authorization.

12. Personal data

The information collected is necessary for processing orders and the commercial relationship.
It is processed in accordance with the Site's Privacy Policy and the GDPR.

13. Governing law and jurisdiction

These Terms are governed by French law.
In the event of a dispute, the French courts have jurisdiction, unless mandatory rules provide otherwise.

14. Mediation

In accordance with article L.616-1 of the French Consumer Code, the Customer may refer the matter to a consumer mediator if a dispute persists after a complaint.
